Open Book Listing
Terms and Conditions
Last updated November 4, 2026
These terms are an agreement between you and Open Book Listing LLC ("we", "us"), which operates Open Book Listing (the "Service"). By creating an account, following a sale, or using a showing, feedback or open house link, you agree to these terms. If you do not agree, please do not use the Service.
1. What the Service Is
Open Book Listing helps listing agents and brokerages share listing activity with home sellers: showings, buyer feedback, open houses, online interest, market context, milestones and reports. It also lets buyer's agents request showings and leave feedback.
The Service is a communication and reporting tool. It is not a brokerage, does not give legal, tax, lending or appraisal advice, and does not replace the judgment of a licensed real estate professional.
2. Accounts
- You must be at least 18 and give accurate information.
- Keep your password and sign-in links private. You are responsible for activity on your account.
- Brokerages and agents control who they invite and what access they grant. Email us right away if you think your account was used without permission.
3. Agent and Brokerage Responsibilities
If you use the Service as an agent or brokerage staff, you confirm that:
- You have the right to share the listing information, photos and documents you add, and the seller has agreed to their use.
- You have a lawful basis and any consent the law requires to contact the sellers, buyer's agents and hosts you invite or message through the Service.
- Your use follows the Telephone Consumer Protection Act, CAN-SPAM, the Fair Housing Act, your state license law, and your brokerage and MLS rules.
- You decide what entry codes and access instructions to share and who receives them. Confirm showings and access with care.
- You keep the information you see about other people private and use it only for the sale it belongs to.
4. Sellers
Sellers are invited by their agent and see their own home's activity. Feedback comes from buyer's agents and reflects their opinion, not ours. If something looks wrong, talk with your agent. Your listing agreement with your agent or brokerage is separate from these terms.
5. Buyer's Agents and Open House Hosts
- Request only showings you intend to attend and cancel through your link if plans change.
- Use entry codes and access instructions only for the confirmed showing and do not share them.
- Leave honest, professional feedback. Do not include buyers' private financial details or anything discriminatory.
6. Text Messages
By giving a mobile number for a showing, a listing or an account, you agree to receive texts about that activity, such as requests, confirmations, reminders and feedback requests. These are not marketing. Frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help, or Email us. Carriers are not liable for delayed or undelivered messages.
7. Market Data, Grades and AI Summaries
Online views, nearby sales, competing homes, median prices, mortgage rates and similar figures come from public sources and third parties. They can be delayed, incomplete or wrong, and we do not guarantee them. Listing grades follow fixed rules applied to saved activity. Some written summaries are produced with help from an AI model. Grades, summaries and recommendations are for information only and are not appraisals or pricing advice. Pricing decisions belong to the seller and their agent.
8. Acceptable Use
You agree not to:
- Use the Service for anything unlawful, discriminatory, harassing or deceptive.
- Upload content you do not have rights to, or malware.
- Try to access listings, accounts or data you were not given, or test, probe or bypass our security.
- Scrape, copy or resell the Service or its data, or use it to build a competing product.
- Send spam or messages to people who have opted out.
9. Your Content and Our Service
You keep ownership of the content you add, such as listing details, photos, notes and feedback. You give us a limited license to host, process, display and send that content only to run and improve the Service for you and the people you share it with.
We own the Service, including its software, design, report formats, grading rules, templates and wording. We may use anonymized, aggregated information that does not identify any person or property to improve the Service.
10. Confidentiality
While using the Service, including during any beta or early access period, you may see features, designs, workflows, report formats, grading rules, pricing, roadmaps and other non-public information about the Service ("Confidential Information"). You agree to:
- Use Confidential Information only to use and evaluate the Service.
- Not share, publish, post, screenshot or record Confidential Information for anyone outside your team or brokerage without our written permission. Sharing listing activity and reports with sellers and other people through the Service, as the Service is designed to work, is allowed.
- Not copy, reverse engineer, decompile or study the Service in order to recreate its features, design or logic.
- Protect Confidential Information with at least the same care you use for your own private business information, and no less than reasonable care.
Confidential Information does not include information that is or becomes public through no fault of yours, that you already knew before we shared it, or that you develop on your own without using it. If the law requires you to disclose Confidential Information, tell us promptly so we can seek protection, and disclose only what is required.
Feedback. If you send us ideas, suggestions or feedback, you give us all rights to them. We may use them freely without paying you or giving you credit.
When access ends. When your access ends, or if we ask, you will delete any Confidential Information you hold within ten (10) days. Your obligations in this section continue after any beta period or your access ends.
Remedies. A breach of this section could cause harm that money alone cannot fix. In addition to any other remedies, we may seek an injunction, as Section 17 allows.
11. Fees
During the beta, access may be free or discounted. Before any paid plan begins, we will tell you the price and terms, and you can choose whether to continue. Paid plans, when offered, renew until cancelled, and fees already paid are non-refundable unless the law requires otherwise.
12. Suspension and Ending Use
You can stop using the Service at any time. We may suspend or end access if these terms are broken, if required by law, or to protect users or the Service. Brokerages may remove agents and agents may remove sellers. When access ends, you can ask us for a copy of your information for a reasonable period, as described in our Privacy Policy.
13. Third-Party Services
The Service links to and relies on other services, such as home search sites, map and data providers and message carriers. We are not responsible for their content, availability or practices.
14. Disclaimers
THE SERVICE IS PROVIDED AS IS AND AS AVAILABLE. TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT PROMISE THE SERVICE WILL BE UNINTERRUPTED, ERROR FREE OR THAT ANY MESSAGE WILL BE DELIVERED.
15. Limitation of Liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST SALES, LOST DATA, OR PROPERTY ACCESS, LOSS OR DAMAGE ARISING FROM A SHOWING OR SHARED ENTRY DETAILS. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR ONE HUNDRED US DOLLARS.
16. Indemnity
If you use the Service as an agent or brokerage, you agree to defend and hold us harmless from claims arising from the content you add, the messages you send or authorize, the access you grant to a property, or your breach of these terms or the law.
17. Disputes
These terms are governed by the laws of the State of Texas. If a dispute comes up, contact us first and we will try to resolve it informally within 30 days. If we cannot, the dispute will be resolved by binding individual arbitration in Denton County, Texas, except that either side may bring a qualifying claim in small claims court or seek an injunction to protect intellectual property. Claims may only be brought individually, not as part of a class or representative action.
18. Changes to These Terms
We may update these terms as the Service grows. For meaningful changes, we will update the date above and notify account holders before the change takes effect. Continuing to use the Service after that means you accept the updated terms.
